US dog attack owner charged with involuntary manslaughter

Friday, March 25, 2005A Spotsylvania County woman, whose three dogs allegedly attacked and killed her elderly neighbor, was freed Wednesday by posting a $10,000 bond. Dianna Large, 36, received one felony charge of involuntary manslaughter and three misdemeanor charges in an indictment issued last week.

In her first appearance before a judge, she answered Circuit Court Judge William H. Ledbetter questions with simple “Yes sir.” and “No sir.” responses. The short hearing, held Thursday, formalized the charges against her. The involuntary manslaughter charge, a first in the severity of punishment being sought on a dog owner in the Virginan state of USA, carries a maximum penalty of 10 years.

State procecutor Wiliam Neely said that Large knowingly let her three Pit Bull dogs run free, and that an animal control agency person had warned her to keep them under better control. She also a violated a county ordinance requiring owners of dangerous dogs to post a warning sign to visitors. The prosecution also noted that none of the three male dogs were neutered.

The Animal Control Department of Virginia maintains a dangerous dog registry. It contains a list of owners whose dogs are deemed dangerous to society. The link to the registry was moved to a more prominent position on the county web page following the attack.

Two people were killed yesterday afternoon and another seriously injured in Västerås, Sweden. The injured man is considered a suspect in the knife attack and was arrested in hospital. Another man was arrested at the scene, which was an IKEA furniture retailer. According to police, the two fatalities do not have any obvious connection to the suspects, but did know each other. The motive is, thus far, unknown.

Police were called to the scene at 13:00 local time and found three stab victims. Initially, all three were considered victims, but the status of one has been changed to suspect. The other two, a man and a woman, subsequently died from their wounds. Police have said CCTV is helping in the investigation. Local newspaper Vestmanlands Läns Tidning (VLT) has reportedly posted footage of one of the suspects being tackled by police.

VLT has further claimed to have identified the two victims as a mother and son, aged 55 and 28 respectively. According to the paper, the victims were not local residents, but did have a connection with Västerås, where they were vacationing at the time of the attack, which a police spokesperson has called “an act of madness” ((sv))Swedish language: ?En galen händelse.

“This is the worst working day of my life” ((sv))Swedish language: ?Det är den värsta arbetsdagen i mitt liv, said Mattias Johansson, the store manager of IKEA in Västerås, to Sveriges Television. IKEA spokesperson Anna Pilkrona-Godden told BBC News, “Our thoughts are with those affected,” and said the store is closed for the time being.

Västerås is in central Sweden, approximately 115 km (70 miles) west from the capital Stockholm. The population is roughly 110 thousand.

The U.S. House of Representatives approved the Central American Free Trade Agreement (CAFTA) early morning Thursday, with a narrow vote of 217 in favor, 215 against. Voting was held open for an hour, 45 minutes past the House’s 15-minute voting rule as the President along with other supporters lobbied into the night.

The vote was so close, if one House member changed a “Yea” vote to a “Nay” vote, CAFTA would have failed in a 216-216 tie.

In tallying the votes, 25 Republicans, mostly from Midwest Corn Belt and Rust Belt states and the Southeast United States’s textile industrial belt, broke party line to vote against the measure. Two Republicans were present, but refused to vote.

The Democrats presented a more united front. All but 15 Democrats present voted against the treaty. Independent House members, who usually vote with the Democrats also voted against the measure.

Supporters of the measure include President George W. Bush, Vice President Dick Cheney, U.S. Trade Representative Rob Portman and Commerce Secretary Carlos Gutierrez. Opponents included most House Democrats.

The trade agreement already passed the Senate in June. President Bush has said he will sign it into law.

DR-CAFTA encompasses the following components:

  • Services: all public services are to be open to private investment.
  • Investment: governments promise to grant ironclad guarantees to foreign investment.
  • Government procurement: All government purchases must be open to transnational bids.
  • Market access: governments pledge to reduce and eventually to eliminate tariffs and other measures that protect domestic products.
  • Agriculture: duty-free import and elimination of subsidies on agricultural products.
  • Intellectual property rights: privatization of and monopoly over technological know-how.
  • Antidumping rules, subsidies and countervailing rights: governments commit to phase out protectionist barriers in all sectors.
  • Competition policy: the dismantling of national monopolies.
  • Dispute resolution: the right of transnationals to sue countries in private international courts.
  • Environmental protection: the enforcement of environmental laws and improvement of the environment.
  • Labor standards: the enforcement of the International Labour Organization‘s core labor standards.
  • Transparency: the reduction of government corruption.
  • Test-Data Exclusivity for pharmaceutical corporations

Despite the White House’s initial assertion that Federal Bureau of Investigation (FBI) Director James Comey was dismissed Tuesday over mishandling the Hillary Clinton email case, United States President Donald Trump on Thursday told NBC that “this Russia thing” was among his reasons, mentioning Comey’s repeated claims that he, Trump, was not being investigated. He also accused Comey of “showboating” and said “the FBI has been in turmoil.”

James Comey was leading an investigation into the Trump campaign’s alleged ties to Russia and possible Russian involvement in the 2016 US presidential election that placed Trump in power. The official reason given for his dismissal, overly harsh treatment of then-presidential candidate Hillary Clinton, was met with skepticism from politicians and the press.

[W]hen I decided to just do it, I said to myself, I said: ‘You know, this Russia thing with Trump and Russia is a made up story, it’s an excuse by the Democrats for having lost an election that they should’ve won.’

President Trump also told NBC’s Lester Holt that, despite statements to the contrary by Vice President Pence and Sean Spicer, recommendations from deputy attorney general Rod Rosenstein did not have anything to do with his decision, which he made before receiving Rosenstein’s memo. “Regardless of recommendation I was going to fire Comey. Knowing, there was no good time to do it[…] And, in fact, when I decided to just do it, I said to myself, I said: ‘You know, this Russia thing with Trump and Russia is a made up story, it’s an excuse by the Democrats for having lost an election that they should’ve won.'” He went on to express regret that firing Comey might prolong the investigation and said Comey had told him that he, Trump, was not under investigation when asked.

Trump told NBC that he had asked Comey if he, Trump, were under investigation, to which Comey had replied in the negative. While it is not illegal under U.S. law for President Trump to ask if he is under investigation, former U.S. Department of Justice spokesperson Matthew Miller described it as “completely inappropriate” and pointed out that Comey would not be allowed to answer under Department rules.

Deputy White House Press Secretary Sarah Huckabee Sanders disagreed with Miller’s assessment. “I don’t see it as a conflict of interest and neither do many of the legal scholars who’ve been commenting on it over the last hour.” She did not elaborate on the reference to legal scholars.

While some sources have said Comey requested more resources for the Russia investigation only days before being fired, one of his associates told news outlets this was not true and the investigation had no shortage of resources.

In his interview with Holt, President Trump affirmed that his campaign had no connections to Russia.

Four candidates for Comey’s position were scheduled to be interviewed today: a lawyer named Alice Fisher, an appeals court judge named Michael Garcia, Senator John Cornyn of Texas, and Andrew McCabe, who is currently serving as acting director of the FBI. McCabe has promised to “vigorously and completely” continue the Russia investigation and to tell Congress if any pressure is brought to bear to stop it.

Wheelchair Rugby Tri-Nations Series begins in Sydney

Cathedral Square, Sydney, Australia —Wikinews attended the Wheelchair Rugby Tri-Nations Series in Cathedral Square, Sydney, ongoing from Wednesday. This is the first time an international wheelchair rugby event has been held outdoors, and in this arena. Three nations are competing: the United States, Australia, and New Zealand.

The venue is Cathedral Square, Sydney, which is adjacent to Hyde Park. The Sydney Central Business district is on the other side of the park. An outdoor stadium has been constructed specifically for the tournament, which is believed to be the first time an international wheelchair rugby tournament has been held outdoors. This choice was validated by the fine and warm weather. Free sunscreen was given to the crowd.

The Opening Ceremony was officiated by Australian Paralympic Committee Chief Executive Officer Jason Hellwig. In attendance were the Premier of New South Wales, Barry O’Farrell, the Deputy Lord Mayor of Sydney, Robyn Kemmis, and Paralympic swimmer Matthew Cowdrey. A large crowd, mostly consisting of school groups, was entertained by boy band Justice Crew singing their hit Best Night.

Each team is to play the others two twice, on Wednesday September 18 and Thursday September 19. Finals are to be held on Friday. All three teams are highly ranked internationally. The United States team is ranked number one in the world. It won bronze at the 2004 Summer Paralympics in Athens, gold at the 2008 Summer Paralympics in Beijing, and bronze at the 2012 Summer Paralympics in London, and is the current world champion. This is its first visit to Australia since the 2000 Summer Paralympics.

The Australian team, known as the Steelers, is ranked second in the world. It won silver in Beijing and gold in London. The team is almost unchanged from the one that won in London. Greg Smith has become the assistant coach.

The first game, held immediately after the Opening Ceremony, was between the United States and Australia. The United States proved the better team, forcing errors and turnovers. Three turnovers in the first quarter were especially costly for the Steelers, who lost 56–43.

The second game was held at 17:30 under lights. The crowd was small, but there were a number of New Zealand fans in the crowd, including a few Maori. Two of the New Zealand players are also Maori. The well-disciplined United States team proved too good for the Wheel Blacks as well, who lost 58–40 in an entertaining contest.

The third game was at 19:30, between Australia and New Zealand. The Australians led the whole game, which was nonetheless entertaining to the last. In the dying seconds of the game, Australia’s Ryley Batt shunted a stalling New Zealand player across the line to force him to score, then threw the ball to team mate Chris Bond, who raced for the line at high speed but was beaten by the buzzer. Australia won 61–48.

The New Zealand team, known as the Wheel Blacks, is ranked tenth in the world. It won gold in Athens.

Highlights of the tournament are scheduled to be shown on Foxtel Sports in Australia on September 28 and 29.

If you have been arrested or accused of a crime that has the potential of jail or prison time, you may want to seriously consider hiring an attorney to represent you. Unless you don’t mind the possibility of spending time in jail, you’ll probably want the services of an attorney.

Almost any expert will strongly advise a person against representing him or herself in court unless they are very knowledgeable about the field of law; and even then he or she will still be discouraged from representing him or herself for a criminal case. Less than one percent of people represent themselves in a criminal case. The vast majority of people engage the services of an attorney. That is because it is very difficult for someone to represent him or herself in court.

You wouldn’t want someone without any knowledge of how to do heart surgery doing a heart transplant on you would you? Likewise, would you want to represent yourself in court and face possible prison time without having the best possible legal advice available to you?

If a person cannot afford to hire an attorney the court will appoint an attorney, typically called a public defender. The constitution of the United States requires a person be provided with legal representation if they cannot afford it. But it is only required if a person is facing possible jail or prison time. If a person is only facing the possibility of a fine, the court is not required to provide the defendant with an attorney.

A court appointed attorney may not cost the defendant any money or the defendant may receive the court appointed attorney at reduced fees. It depends on the income of the defendant. If a person wants a public defender they will be required to fill out financial documents for the court to determine whether or not they qualify for a public defender and also whether or not that they receive the services of the public defender for free or at a reduced cost.

If a person qualifies for a reduced cost court appointed attorney, it is generally called a partial indigency. At the conclusion of their case, the judge will require the defendant to reimburse the county or state for a specific portion of their legal fees. The rates are usually much lower than those charged by private defense attorneys.

If you do not qualify for a court appointed attorney and are hiring one on your own, how do you find one? Personal recommendations from people you know are almost always the best way to find an attorney. Other sources of information to help find a criminal attorney are: Internet, Yellow Pages, your civil practice attorney, your local bar association lawyer referral panel (if they have one) and the Martindale-Hubbell publications.

The Martindale-Hubbell publications are available at most libraries and on the Internet. The publications do their best to list every attorney in the US by geographical area and lists the area or areas of law that attorney specializes in.

When hiring a criminal attorney on your own, try to interview several attorneys before hiring one or ask your family and friends help you. It is important to find an attorney you feel comfortable discussing all aspects of your case with. Some defense attorneys offer a no cost personal interview consultation. One thing to remember when hiring an attorney: make sure you hire an attorney who specializes in your area of criminal law.

Most attorneys will require an up-front retainer fee which can be a significant amount depending on the type of criminal case you have.

Some attorneys charge a set fee for handling a specific type of case. But it is more common for an attorney to charge by the hour. Some attorneys who charge by the hour will set a cap fee for the case. That means a sum will be agreed on that is the highest amount the defendant has to pay. If the hourly costs reach this set amount, the lawyer will finish representing the defendant through to the completion of the case without charging any more money.

Although contingency fees, which are where an attorney only gets paid if he or she wins the case, are common with certain types of civil cases, they are not used with criminal cases. Contingency fees are considered unethical and are not permitted in criminal cases.

In addition to knowing what fees an attorney will be charging, a defendant also needs to know what services those fees cover and do not cover. Fees such as the cost of expert witnesses are normally not included in the normal fees of an attorney.

Torture proliferates American headlines today: whether its use is defensible in certain contexts and the morality of the practice. Wikinews reporter David Shankbone was curious about torture in American popular culture. This is the first of a two part series examining the BDSM business. This interview focuses on the owners of a dungeon, what they charge, what the clients are like and how they handle their needs.

When Shankbone rings the bell of “HC & Co.” he has no idea what to expect. A BDSM (Bondage Discipline Sadism Masochism) dungeon is a legal enterprise in New York City, and there are more than a few businesses that cater to a clientèle that wants an enema, a spanking, to be dressed like a baby or to wear women’s clothing. Shankbone went to find out what these businesses are like, who runs them, who works at them, and who frequents them. He spent three hours one night in what is considered one of the more upscale establishments in Manhattan, Rebecca’s Hidden Chamber, where according to The Village Voice, “you can take your girlfriend or wife, and have them treated with respect—unless they hope to be treated with something other than respect!”

When Shankbone arrived on the sixth floor of a midtown office building, the elevator opened up to a hallway where a smiling Rebecca greeted him. She is a beautiful forty-ish Long Island mother of three who is dressed in smart black pants and a black turtleneck that reaches up to her blond-streaked hair pulled back in a bushy ponytail. “Are you David Shankbone? We’re so excited to meet you!” she says, and leads him down the hall to a living room area with a sofa, a television playing an action-thriller, an open supply cabinet stocked with enema kits, and her husband Bill sitting at the computer trying to find where the re-release of Blade Runner is playing at the local theater. “I don’t like that movie,” says Rebecca.

Perhaps the most poignant moment came at the end of the night when Shankbone was waiting to be escorted out (to avoid running into a client). Rebecca came into the room and sat on the sofa. “You know, a lot of people out there would like to see me burn for what I do,” she says. Rebecca is a woman who has faced challenges in her life, and dealt with them the best she could given her circumstances. She sees herself as providing a service to people who have needs, no matter how debauched the outside world deems them. They sat talking mutual challenges they have faced and politics (she’s supporting Hillary); Rebecca reflected upon the irony that many of the people who supported the torture at Abu Ghraib would want her closed down. It was in this conversation that Shankbone saw that humanity can be found anywhere, including in places that appear on the surface to cater to the inhumanity some people in our society feel towards themselves, or others.

“The best way to describe it,” says Bill, “is if you had a kink, and you had a wife and you had two kids, and every time you had sex with your wife it just didn’t hit the nail on the head. What would you do about it? How would you handle it? You might go through life feeling unfulfilled. Or you might say, ‘No, my kink is I really need to dress in women’s clothing.’ We’re that outlet. We’re not the evil devil out here, plucking people off the street, keeping them chained up for days on end.”

Yahoo!, the world’s favorite Internet destination, reported $373 million in net income for the three month period ended December 31. Revenues were $1,078 million for the fourth quarter of 2004, a 62 percent increase compared to $664 million for the same period of 2003. “We are attracting more and more users to Yahoo!’s network of services and driving their usage deeper with more relevant products and services. This deeper usage is the real magic behind the surpassing of our financial objectives,” explained Susan Decker, the company’s chief financial officer.

  • Revenues excluding traffic acquisition costs (“TAC”) were $785 million for the fourth quarter of 2004, a 54 percent increase compared to $511 million for the same period of 2003
  • Gross profit for the fourth quarter of 2004 was $691 million, a 56 percent increase compared to $443 million for the same period of 2003
  • Operating income for the fourth quarter of 2004 was $235 million, a 149 percent increase compared to $94 million for the same period of 2003
