City of Edinburgh Council seek to improve local music scene

Yesterday evening saw the Usher Hall in Edinburgh host a meeting between representatives of the City of Edinburgh Council (CEC) and the local rock and pop music scene. The meeting was dominated with local musicians’ complaints over the “zero tolerance” policy Edinburgh is viewed as having adopted towards amplified music.The meeting began with the leading panel — Norma Austin Hart, vice-convener for Culture and Sport; John Stout, promoter from Regular Music; Kevin Buckle, of local store Avalanche Records; and Karl Chapman, manager of the Usher Hall — introducing themselves and outlining the purpose of the meeting. This being best-summarised as a desire to emulate the vibrant music scene of places as far-flung as Austin, Texas and Sydney, Australia.

Councillor Hart indicated officials from Austin had already offered to get involved in improving the live music scene in the city; although none were present from Austin, US-born local musician Pat Dennis provided his frank opinion on where Edinburgh fails to nurture the local music scene: that failure to support a grass-roots, small venue, music scene prevents the city being capable of organising events similar to Austin’s South by Southwest festival outwith August, when Edinburgh hosts the Festival and Fringe.

Coming in for the lion’s share of criticism, staff from CEC’s Licensing Board were visibly uncomfortable when the topic of the “single complainant” was brought up time and time again. Unlike any other business within the city, or residential properties, noise pollution within premises permitted to sell alcohol is not managed by environmental health staff. That responsibility is bundled with the alcohol license, which leaves publicans fearful that their premises will be forced to close if they do not comply with demands to cease use of any amplification, or hosting live music. This was characterised as a ‘tyranny of the minority’, a most-undemocratic approach where one person — for example, recently moved into a property adjacent to a long-established premises hosting live music — could force the closure of a business which has hosted local talent for 30+ years.

Taking heed of the strength of feeling from the majority present, Councillor Hart made a number of personal commitments towards the end of the meeting. Those included setting up a working group, Music is Audible, to look at how the council could better work with venues, and to have a follow-up meeting in March next year.

Lobby groups oppose plans for EU copyright extension

The European Commission currently has proposals on the table to extend performers’ copyright terms. Described by Professor Martin Kretschmer as the “Beatles Extension Act”, the proposed measure would extend copyright from 50 to 95 years after recording. A vast number of classical tracks are at stake; the copyright on recordings from the fifties and early sixties is nearing its expiration date, after which it would normally enter the public domain or become ‘public property’. E.U. Commissioner for the Internal Market and Services Charlie McCreevy is proposing this extension, and if the other relevant Directorate Generales (Information Society, Consumers, Culture, Trade, Competition, etc.) agree with the proposal, it will be sent to the European Parliament.

Wikinews contacted Erik Josefsson, European Affairs Coordinator for the Electronic Frontier Foundation (E.F.F.), who invited us to Brussels, the heart of E.U. policy making, to discuss this new proposal and its implications. Expecting an office interview, we arrived to discover that the event was a party and meetup conveniently coinciding with FOSDEM 2008 (the Free and Open source Software Developers’ European Meeting). The meetup was in a sprawling city centre apartment festooned with E.F.F. flags and looked to be a party that would go on into the early hours of the morning with copious food and drink on tap. As more people showed up for the event it turned out that it was a truly international crowd, with guests from all over Europe.

Eddan Katz, the new International Affairs Director of the E.F.F., had come over from the U.S. to connect to the European E.F.F. network, and he gladly took part in our interview. Eddan Katz explained that the Electronic Frontier Foundation is “A non-profit organisation working to protect civil liberties and freedoms online. The E.F.F. has fought for information privacy rights online, in relation to both the government and companies who, with insufficient transparency, collect, aggregate and make abuse of information about individuals.” Another major focus of their advocacy is intellectual property, said Eddan: “The E.F.F. represents what would be the public interest, those parts of society that don’t have a concentration of power, that the private interests do have in terms of lobbying.”

Becky Hogge, Executive Director of the U.K.’s Open Rights Group (O.R.G.), joined our discussion as well. “The goals of the Open Rights Group are very simple: we speak up whenever we see civil, consumer or human rights being affected by the poor implementation or the poor regulation of new technologies,” Becky summarised. “In that sense, people call us -I mean the E.F.F. has been around, in internet years, since the beginning of time- but the Open Rights Group is often called the British E.F.F.

Aerial collision over Austria kills 8

An aerial collision near Zell am See, Austria has killed 8 people, 5 Swiss citizens, 1 French, 1 German and 1 Austrian.

The collision occurred Monday afternoon between a Super Puma helicopter belonging to Helog S.A, based in Küssnacht (Switzerland), and a private Diamond DA20 “Katana” light aircraft which had taken off from the aerodrome at Zell am See.

All 7 of the passengers and crew from the helicopter were pronounced dead at the scene, as was the pilot of the light aircraft, which had no passengers on board.

The debris from the accident spread over a 20 metre radius and bystanders near to the incident reported seeing a “huge ball of fire in the sky”.

The reason for the accident is presently unclear as both craft have been confirmed as passing pre-flight testing at their respective take-off locations. Furthermore, Zell am See tower radioed the helicopter that a plane was taking off, to which the helicopter replied positively. This conversation should have been heard over radio by the pilot of the plane.

The site of the accident is now being guarded by police, pending the arrival of an investigation team and a delegate of the state attorney.

Crossrail set to only compensate £50 for land rights, London, UK

The British Parliament approved the first stage of the new Crossrail underground railroad through London as a £15 billion construction project earlier this month. Crossrail is the first major new train line to be built in London in decades.

The rail line being implemented as a hybrid bill in Parliament. After a second reading in Parliament, it was voted upon and decided that the government will commit to the project so that the line will be built.

The next issue before Parliament of to ensure that the implementation of the bill so it is consistent with private interests of neighborhoods to be affected by Crossrail. This is when residents can petition Parliament to change the way the line is constructed.

As a result of construction of the Crossrail line, hundreds of homes will have new tunnels excavated beneath them.

On contacting Crossrail, they have indicated approximately £50 will be offered to each landowner to buy all the land rights-of-way to build the train tunnel more than 9 meters below the residential buildings. The average value for properties in the affected areas is £350,000.

Under UK compulsory purchase laws to be used in this bill, the residents are entitled to the difference in the value of the whole property with and without a tunnel under it. If the offer given by Crossrail is not accepted by any of the residents, the residents can take the case to the Land Tribunal, where the fair value will be established.

This however, could be cost prohibitive. Crossrail does not indicate that it will attempt to assign a fair value in the original offer and instead is only going to offer around £50 per property in the hope that not many people take the matter to the Land Tribunal.

Auto accidents happen all the time. In fact, statistics confirm that most of us have either been involved in a car accident or know someone who has. We also know that injuries from car accidents can be very serious, even if the injured victim doesn’t break a bone or have a more ‘obvious’ injury.

How you handle the accident can make a big difference later on down the road. In Pennsylvania, the ability to make a claim for pain, suffering and lost wages and property damages are governed by the Pennsylvania Motor Vehicle Responsibility Law (MVFRL). The MVFRL outlines each person’s rights and, depending upon the type of insurance you have, whether you are entitled to recover damages for pain and suffering. For example, whether YOU purchased limited tort or full-tort coverage has a huge impact upon whether you will be able to be compensated for your pain and suffering. But once you are in the accident, you can’t change your insurance coverage. Instead, there a few things you should do.

First, always write down the time and place (intersection, city, streets, and other landmarks) where the accident occurred. Next, get the name, address and driver’s license number of each driver involved in the accident – and get the names, addresses and phone numbers of every witness to the accident. Also, you should write down the make and model of each other car involved in the accident, as well as the license plate number. In addition, take a picture of your car and each other car; your cell phone probably has a camera. If you believe you are injured, you should also be sure that the police are notified about the accident and that they came to the scene and created a police report. If you do these things, you can later prove that you and the other vehicles were present at the scene.

Next, notify your insurance company. Tell the company about the accident so that it has a record of the claim. In addition, if you think you were hurt, tell the police officer and your insurance company – no matter how serious or minor you think your injuries are. That way, if you really start hurting a day or a week later, there is a record of your complaints. That doesn’t mean to say you are hurt if you weren’t. If you’re fortunate to escape the accident without injury, be glad. Also, if you have any concerns about your health, go to your family doctor or to the Emergency Room and get treated. Sometimes people think they aren’t hurt and turn out to be seriously injured. Protect yourself.

If you take these basic steps, and later make a claim seeking compensation for your pain and suffering and other injuries, the defendants will be more likely to believe you and won’t argue that you weren’t hurt because you didn’t go directly to the Emergency Room. Remember, being involved in a car accident is serious, and you should always do everything you can to protect your rights.

Cook Islands rugby league player Adam Watene dies after training session age 31

Cook Islands and Wakefield Trinity Wildcats rugby league player Adam Watene has died. The Wildcats announced the death of the 31-year-old earlier today. They reported he collapsed in the gym shortly after a training session.

A spokesman said, “The Wakefield Trinity Wildcats are sad to announce the sudden passing of Adam Watene. The circumstances surrounding Adam’s death were sudden and unexpected. Everyone at the Wildcats’ thoughts are with Adam’s family, and we ask for their privacy to be respected at this difficult time.”

Watene started his rugby league with the Castleford Tigers and was later signed by the Bradford Bulls. After a year of playing for the bulls of which he only made five first team appearances, he was allowed to sign for the Wakefield Trinity Wildcats. He played a total of 28 games in the two seasons he was with the club.

The Wildcats also said “There will be no further comment from the club at this stage.” Watene is survived by his wife and two children.

A Pembroke Pines, Florida teenager killed himself Wednesday, November 19, while broadcasting on the live video site Justin.tv. After making suicide threats and being encouraged by Justin.tv viewers and Bodybuilding.com forum members, Abraham K. Biggs, 19, committed suicide by taking an overdose of opiates and benzodiazepine, which had been prescribed for his bipolar disorder.

Biggs first began blogging about his planned suicide 12 hours before the actual event. He died after taking pills and lying on the bed in front of the webcam. After the broadcast, viewers who apparently thought it was a hoax posted messages such as “OMG”, “LOL”, and “hahahah”.

Hours later, after being alerted by viewers who had noticed that Biggs had stopped breathing, law enforcement and paramedics arrived, discovered his body, and covered the camera. The Broward County Medical Examiner’s Office has reportedly confirmed Biggs’ death.

According to Montana Miller of the Bowling Green State University, the circumstances of this case were not shocking: “If it’s not recorded or documented, then it doesn’t even seem worthwhile. For today’s generation it might seem, ‘What’s the point of doing it if everyone isn’t going to see it?'”

Biggs’ sister Rosalind was angry that neither the website nor its viewers reacted soon enough to save him. “They got hits, they got viewers, nothing happened for hours,” she said. She described him as “very happy” and “friendly and outgoing.” “On a normal day, you couldn’t really tell that he got as low as he did.” However, he did have relationship problems with his girlfriend, according to a friend.

Mental health professionals have warned about the possibility that other mentally troubled people would copy his actions. According to Dr. David Shaffer of Columbia University, “Any video showing it as heroic or romantic or glamorous could reduce the anxiety people might feel about suicide. It becomes a respectable behavior and lowers the threshold of suicide.” He and other psychiatrists recommend that potentially suicidal teens talk to others and “tell what’s going on.”
